DMCA Policy

Overview

Music Sound (musicsound.ca) respects the intellectual property rights of creators and artists, and expects all users of our platform to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid notices of alleged copyright infringement submitted in accordance with the DMCA (17 U.S.C. § 512).

Reporting Copyright Infringement

If you believe that content hosted on Music Sound infringes your copyright, please submit a DMCA takedown notice to our designated copyright agent. Your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or authorized representative.
  2. Identification of the copyrighted work you claim has been infringed (e.g., song title, album, recording).
  3. Identification of the specific content on musicsound.ca that you claim is infringing, with enough detail for us to locate it (URL, track name, etc.).
  4. Your full name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

We recommend submitting notices via email for the fastest response. Incomplete notices will not be processed.

What Happens After a Notice is Received

Upon receipt of a valid DMCA takedown notice, Music Sound will:

  • Promptly remove or disable access to the allegedly infringing content.
  • Notify the user who uploaded the content that it has been removed.
  • Provide the user with an opportunity to submit a counter-notification if they believe the removal was in error.

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the content that was removed and its location before removal.
  3. A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
  4. Your name, address, phone number, and email address, and a statement that you consent to jurisdiction of the federal court in your district.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the content after 10–14 business days unless the complainant files a court action.

Repeat Infringer Policy

Music Sound has a zero-tolerance policy for repeat copyright infringers. Users whose accounts are subject to multiple valid DMCA notices will have their accounts permanently suspended in accordance with our Terms of Service.

Misrepresentation Warning

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake, may be liable for damages, including costs and attorneys' fees. Ensure your claim is made in good faith before submitting a notice.
